Description
Order Petitioner-appellant, a pro se federal prisoner, appeals from a district court judgment dismissing petitioner's motion to vacate filed pursuant to 28 U.S.C. § 2255. This case has been referred to a panel of the court pursuant to Rule 9(a), Rules of the Sixth Circuit. Upon examination, this panel unanimously agrees that oral argument is not needed. Fed. R. App. P. 34(a). Petitioner raises four issues on appeal. First, he argues that the district court Judge failed to conduct a de novo review of the magistrate Judge's report and recommendation. Second, he argues that he received ineffective assistance of trial counsel. Third, he argues that he received ineffective assistance of appellate counsel. Fourth, he argues that the alleged perjury of a government witness violated his Sixth Amendment right to a fair trial and his Fifth Amendment right to due process.
